Notwithstanding the foregoing, Landlord shall be required to notify Tenant at the time of Landlord’s approval of the Final Space Plans or Final Working Drawings or any Alterations if Tenant shall be required to remove certain Leasehold Improvements, and restore the Premises to its condition immediately prior to the improvements described in the Final Space Plans or Final Working Drawings or Alterations plans, at the expiration of the Term or other termination of the Lease.Īfter Tenant's approval, or deemed approval, of the Space Plans (the ' Final Space Plans'), Landlord will promptly solicit competitive bids for the cost of the work as set forth in the Final Space Plans. If Landlord reasonably disapproves any aspect of the Final Space Plans, Landlord will advise Tenant in writing of such disapproval and the reasons therefor within five (5) business days after receipt. Landlord shall advise Tenant within five (5) business days after Landlord's receipt of the Final Space Plan for the Premises if the same is unsatisfactory or incomplete in any respect provided, however, Landlord shall only disapprove such Final Space Plans to the extent of a Design Problem. This process will be repeated until the Final Space Plans are mutually approved by Landlord and Tenant. The Final Space Plans, the Approved Working Drawings for Landlord’s Work and Approved Working Drawings for the Tenant Improvements shall be collectively referred to herein as the “Construction Drawings”. The Final Working Drawings shall materially conform to the Final Space Plans, taking into account (i) Space Plan Modifications, (ii) the requirements of the Building Codes, (iii) other modifications resulting from physical constraints of the Premises and (iv) modifications requested by Tenant and consented to by Landlord, which consent shall not be unreasonably withheld.
